1. PURPOSE AND SCOPE OF APPLICATION
These General Terms and Conditions govern the use of the online store of Florentino Colección S.L., with registered office at Polígono Industrial Lalín 2000, Calle B 30-34, 36500 Lalín (Pontevedra), Spain, Tax Identification Number (CIF) ESB36057933, registered with the Commercial Registry of Pontevedra, Folio 197, Book 668, Entry 1, Sheet 9486 (hereinafter referred to as “Florentino”, “the Company” or “we”).
Access to, browsing and use of this online store (hereinafter referred to as the “Platform”) implies the express and unconditional acceptance of these General Terms and Conditions.
2. IDENTIFICATION OF THE DATA CONTROLLER
Florentino Colección S.L. is responsible for the processing of personal data provided by users through the Platform, in accordance with our Privacy Policy.
3. ACCEPTANCE OF THE TERMS AND CONDITIONS
The user declares that they are of legal age and have the legal capacity to enter into contracts. Furthermore, the user undertakes to:

Placing an order implies the express acceptance of these Terms and Conditions.
4. FORMATION OF THE SALES CONTRACT
The sales contract between the user and Florentino shall be considered concluded when the user receives the order confirmation by email.
We reserve the right to reject orders for justified reasons, such as errors in pricing or product availability.
5. TERRITORIAL SCOPE
Sales through this Platform are available only in Spain (excluding the Canary Islands, Ceuta and Melilla) and European Union countries where purchasing is enabled through the country selector.
We do not ship to territories with special customs or tax regimes (for example, the Canary Islands, Ceuta, Melilla, Madeira, the Azores, etc.).
6. PRICES, VAT AND SHIPPING COSTS
The prices displayed on the Platform include the applicable Spanish VAT, unless expressly stated otherwise.
Shipping costs will be indicated during the checkout process before the order is confirmed.
The user shall be responsible for any additional taxes or charges applicable in their country, where applicable.
7. PAYMENT METHODS
Payments shall be made using the payment methods available on the Platform. Payment data is securely processed through external payment service providers (for example, Stripe, PayPal or others); therefore, Florentino does not store complete credit or debit card details.
The user guarantees that they are the holder of the payment method used and that they have authorisation to make the payment.
8. PRODUCT AVAILABILITY
Products are offered while stocks last. In the event of product unavailability, Florentino will inform the user and may offer alternatives or a refund of the amount paid.
9. DELIVERY
Delivery times are indicated in the order confirmation. Delays not attributable to Florentino (due to force majeure or incidents involving the carrier) shall exempt the Company from liability.
10. RIGHT OF WITHDRAWAL
The consumer has the right to withdraw from the contract concluded with Florentino, without giving any reason, within a period of 14 calendar days from the day on which the consumer, or a third party indicated by the consumer other than the carrier, acquires physical possession of the products.
To exercise the right of withdrawal, the consumer may communicate their decision to Florentino by means of the electronic form available on the Website, by email sent to tienda.online@florentino.com or by any other clear statement expressing their decision to withdraw from the contract.
Once the withdrawal has been communicated, the consumer must return the products without undue delay and, in any event, within a maximum period of 14 calendar days from the date on which they communicate their decision to withdraw.
The direct costs of returning the products shall be borne by the consumer and will be deducted from the amount to be refunded in accordance with the applicable return fees indicated on the Platform.
The consumer shall be liable for any diminished value of the products resulting from handling other than what is necessary to establish their nature, characteristics and functioning.
Florentino shall reimburse all payments received from the consumer, including the delivery costs corresponding to the least expensive standard delivery method offered by Florentino, using the same means of payment used for the original transaction, without undue delay and, in any event, within a maximum period of 14 calendar days from the date on which Florentino is informed of the consumer's decision to withdraw.
However, Florentino may withhold such reimbursement until the returned products have been received or until the consumer has provided proof of having sent back the products, whichever occurs first.
The right of withdrawal shall not apply to products which, for reasons of health protection or hygiene, are not suitable for return and have been unsealed after delivery, such as certain underwear, socks, hosiery, face masks or similar products.
Furthermore, the return of personalised products or products made according to the customer's specifications shall not be accepted.
11. IT SECURITY AND PROPER USE
The user undertakes not to introduce viruses, malware or any harmful code into the Platform, nor to carry out actions that may affect its operation or security.
Any improper use may be reported and legally pursued.
12. INTELLECTUAL AND INDUSTRIAL PROPERTY
All content on the Platform (including, but not limited to, trademarks, logos, texts, photographs, designs, codes, etc.) is the property of Florentino or third parties who have authorised its use.
The user may not reproduce, distribute, modify or use such content without prior express written authorisation.
13. LINKS TO THIRD-PARTY WEBSITES
The Platform may contain links to third-party websites. Florentino does not control and shall not be responsible for the content, services or privacy policies of such websites.
14. ELECTRONIC COMMUNICATIONS AND MARKETING
The user agrees to receive communications related to their orders by email.
Prior and express consent shall be required for commercial and marketing communications (email and SMS), in accordance with our Privacy Policy.

16. MODIFICATION OF THE TERMS AND CONDITIONS
Florentino reserves the right to amend these Terms and Conditions at any time. The terms applicable shall be those in force at the time each order is placed.
17. APPLICABLE LAW AND JURISDICTION
These Terms and Conditions shall be governed by Spanish law.
For any dispute, the parties shall submit to the Courts and Tribunals of the consumer's place of residence, where permitted by law, or to those of Pontevedra (Spain).
